Although the account had no legitimate affiliation with 1MDB, Loo was an authorised signatory for the account along with Tan. According to DoJ, Husseiny was chairman of the Aabar-owned Falcon Bank and he was the referee for Tan to open an account with the bank. It is, however, not clear if Tan was the sole signatory and beneficial owner of the account or if Jho Low was also a party.
A supposed copy of that financing agreement was submitted to Falcon Bank to conceal the true nature of the payment to Malaysian Official 1, which, if disclosed to the bank, would have required the bank to engage in additional compliance enquiries to verify the legitimacy of such a large transfer of funds to a high-ranking public official, the DoJ says.
